Criteria for the EB-2 NIW - National interest waiver

Substantial merit and national importance: Your proposed plan must have substantial merit and national importance. This means that your work must benefit the U.S. economy, improve wages and working conditions, promote education and training programs, improve health care, provide more affordable housing, improve the environment, or benefit a U.S. government agency.

Well-positioned to advance the proposed plan: You must demonstrate that you are well-positioned to advance the proposed effort. This can be demonstrated through your education, skills, knowledge, track record of success, a plan for future activities, and any progress made toward achieving your goals.

Balance of Criteria: You must demonstrate that, on balance, it would be beneficial to the United States to waive the job offer and labor certification requirements. This involves showing that the national interest would be adversely affected if labor certification were required.
